NAAA Updates Arbitration Guidelines

NAAA Updates Arbitration Guidelines

Critical Shifts:

  • Targeted Rules Update: Effective June 1, 2026, the NAAA is updating its arbitration guidelines to clarify rules around modern vehicle challenges, specifically targeting advanced driver assistance systems (ADAS), higher-value vehicles, and title issues.

  • Annual Update Cycle: Moving forward, the NAAA is sticking to a predictable, once-a-year update schedule to keep pace with rapid shifts in automotive technology and market conditions, moving away from unpredictable, ad hoc rule changes.

  • Focus on Predictability: The primary goal of these regular updates is to reduce transactional disputes and boost dealer confidence by providing clear, consistent, and practical guidelines for buyers and sellers at auction.

The National Auto Auction Association sent out a notice to members regarding its arbitration guidelines.

As a reminder, NAAA is introducing targeted updates to the NAAA Arbitration Guidelines, effective June 1, 2026. These changes clarify existing policy language, formally reflect established auction practices, and address evolving issues such as higher-value vehicles, announcements, ADAS components, and title considerations – without altering the core intent of the Guidelines.

As introduced last year, NAAA will continue with an annual update cycle for the Arbitration Guidelines. This approach allows the Association to proactively review and refine the Guidelines each year to account for market changes, advancing vehicle technology, and recurring areas of ambiguity – rather than relying on ad hoc revisions or informal interpretations.

Regular, scheduled updates are important to maintaining consistency, fairness, and confidence in the arbitration process. An annual review helps ensure the Guidelines remain practical, up to date, and clearly understood by auctions, buyers, and sellers alike – supporting predictable outcomes and reducing disputes driven by uncertainty.
